Terms and Conditions for Dharura App

Introduction

Welcome to Dharura. By downloading, installing, or using the Dharura emergency response application ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

1. Use of the App

Eligibility

To use the App, you must be at least 18 years old or have the consent of a parent or guardian. By using the App, you represent and warrant that you meet this eligibility requirement.

License

Dharura grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

2. User Accounts

Registration

To access certain features of the App, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. User Responsibilities

Accurate Information

You agree to provide accurate information when using the App, including emergency details and location data, to ensure effective assistance.

Compliance with Laws

You agree to use the App in compliance with all applicable laws and regulations. You must not use the App for any unlawful or harmful purposes.

Prohibited Conduct

You agree not to:

• Use the App in any manner that could interfere with, disrupt, or negatively affect the App or servers.
• Use automated means to access the App.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Engage in any activity that could harm Dharura or its users.

4. Intellectual Property

All intellectual property rights in the App, including but not limited to design, text, graphics, logos, and software, are owned by or licensed to Dharura. You may not reproduce, distribute, modify, or create derivative works from any content of the App without our prior written consent.

5. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the App, you consent to the practices described in the Privacy Policy.

6. Disclaimers

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. Dharura does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

Dharura is designed to help users request assistance in emergency situations such as domestic violence, accidents, or threats to personal safety. The app uses your device's location services (GPS and network data) to transmit your location to our partner emergency service providers or authorized personnel for the purpose of facilitating a response.

Important: While Dharura strives to connect users with emergency responders in real time, we do not guarantee that help will arrive, nor do we control or manage the third-party response teams. Location accuracy may vary depending on your device settings and signal strength. Users are responsible for ensuring that location permissions are enabled. In critical emergencies, users should also attempt to contact local emergency numbers directly (e.g., 999 in Kenya).

By using this app, you acknowledge and agree that Dharura and its affiliates shall not be held liable for delays, non-responses, or outcomes resulting from the use of this application or reliance on the location-based dispatch features.

7. Limitation of Liability

To the fullest extent permitted by law, Dharura shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use of or inability to use the App.
• Any unauthorized access to or use of our servers and/or any personal information stored therein.
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App by any third party.
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the App.

8. Indemnification

You agree to indemnify, defend, and hold harmless Dharura, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the App or your violation of these Terms.

9. Changes to Terms

We may modify these Terms from time to time. We will notify you of any changes by posting the new Terms on the App and updating the effective date. Your continued use of the App after the changes take effect constitutes your acceptance of the revised Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Kenya to resolve any dispute arising out of or relating to these Terms or the App.
